USPTO Reduces Backlog
USPTO Makes Substantial Progress in Reducing Patent Backlog
For the first time in nearly a decade, the USPTO has issued more first office actions in a fiscal year than the number of new applications filed. The backlog has declined to approximately 776,995 applications, down from a peak exceeding 837,000 in early 2025, with further reductions expected.
This progress reflects a meaningful shift in patent examination timelines and overall system efficiency.
The USPTO has turned an important corner, the firm noted and the patent examiners have addressed a substantial backlog under difficult timelines and demanding deadlines, while continuing to meet quality standards. That combination is notable.
The Office is also making progress toward eliminating applications pending more than 36 months, a key driver of overall pendency.
Boston & Galway will continue to monitor these developments and advise clients on how improving timelines may impact patent prosecution strategy.
